In Wheeler it was said that foreign policy was a matter strictly within the expertise of the central government. By overturning the decision to ban the club, the court limited the ability of local authorities to make decisions that could affect foreign policy. Some commentators such as Clive Coleman have, however, argued that judicial review does not successfully realize the constitutional principle of separation of powers. He said there is a constitutional tension between "one powerful executive branch, which likes to circumvent the constitution, taking over everything, and on the other, a small, independent judiciary... which punches way above its limits." ยป.
