Congresswoman Giffords was shot in the head in Tucson, Arizona. After the shooting, a group of lawmakers passed the Law on Safety of Elected Officials, a law aimed at protecting the safety of elected officials in a public place (Skrentny). Governor Jerry Brown was scheduled to deliver a public speech in Los Angeles. However, this was interrupted by a young man named Tim Smith. He chose to attend the speech that day and head to the front, close to where Governor Brown was speaking publicly. Secret Service agents, at an undisclosed time, spotted him and noticed that he was wearing a T-shirt that read: "GOVERNOR BROWN IS IN OUR SIGHTS!" " Additionally, underneath is a statement that "shows a photo of Brown with the image of a rifle's optical scope superimposed on it." Furthermore, to make his intention clear and "to emphasize that he wants Brown out of office", he hand-distributed to others attending the speech "optical rifle sights with the same slogan printed on them", but "little many people pay attention to him” (Skrentny). Did any of Defendant Tim Smith's actions violate the Elected Officials Security Act? Did he violate the liberties of others or California Penal Code §415, the law in Cohen v. California (1971)? Are these laws really valid or constitutional? These are the crucial questions in light of the current controversy. I, Judge Sonny Wong, answer in the affirmative. In addressing all of Tim Smith's actions, he violates both laws and the laws are valid and constitutional. First, consider the Elected Officials Security Act. It can be opposed, reprimanded, and criticized with vitriolic attacks on its validity, particularly based on the manner in which it was stated.
