Essay / The Paintball Case - 1035
The Paintball Case is a perfect example of how restorative justice can be used in society to help both the victim and the offender. If a similar incident had happened in my community, I believe the outcome would have been different. I believe restorative justice would not have been used in this sense and the emotional healing that occurred here would not have been an outcome. Justin would have been tried alone and he would have most likely been sentenced to prison and a lengthy probation term. He also would have had to pay any outstanding medical bills that Jorel's insurance company had failed to pay. The emotional healing that was possible through group conferencing would never have happened in my community because the victim and offender would not have been able to attend a conference. The values that would prevail in my community would not be those of sympathy, empathy, or learning but those of conviction, firmness and justice. Both the victim and the perpetrator needed emotional healing. Sometimes the restorative justice model used in that specific case is more of a punishment for the offender and helps prevent them from reoffending. This is due to the extreme emotional suffering discussed and the healing that prevails at the end of the conference. One of the core values illustrated in this case is meeting the needs of the victim. The current criminal justice system focuses solely on the offender, but the restorative justice model focuses more on the inherent needs of those affected by crimes (Wallace, 2009, P. 152). As noted in the article, Justin said, "I never wanted to hurt anyone" and even offered to donate part of his eye to help. Jorel wanted to meet...... in the middle of a paper ...... which would lead to the uprising of citizens in the fight for their rights. Many parts of this concept are perfect and have huge potential to do great things within it. the criminal justice system. Some things could also cause huge problems. As a community, we must come together and find a way to implement this process into our system and help victims heal from the emotional strain placed on them during a crime. Through trial and error, this system can be refined to meet individual needs and used in certain situations across the country. Number of words: 1,271 works cited: Cavanagh, T. (1998).
