Essay / Seidman's insane plan of constitutional disobedience
A “financial crisis”, an “economic disaster on a scale few countries have ever known”(1), the “Great Recession”, the “Little Depression” , the “Long Recession”, the “global recession of 2009”(2) and “financial implosion”(3) are all expressions used to describe the economic situation in which the United States finds itself in 2012. Louis Michael Seidman, Harvard graduate and Carmack Waterhouse Professor of Constitutional Law at Georgetown University Law Center, called it "fiscal chaos." Professor Seidman believes that the cause of this great chaos lies in the “archaic, idiosyncratic and downright perverse provisions” of the Constitution. Seidman wrote an article in the New York Times titled "Let's Abandon the Constitution" and argues, because of his personal philosophy, that the Constitution should be abandoned. (4) Seidman does not recognize poor banking fiscal policy, lending to unqualified borrowers, government bailouts of private businesses, or perhaps the repeal of the Glass Steagall Banking Act (5) as contributing sources to the financial crisis. Instead, he places all the blame on the founding fathers. Despite Seidman's ridiculous quibbles, the Constitution must be respected to maintain both the strength and freedom that the United States provides its citizens. Seidman uses an insane scheme of “constitutional disobedience” as the basis for his beliefs. (4) He misinterprets history in an attempt to prove his erroneous theory that "the Constitution itself was born of constitutional disobedience." For example, the constitutional law professor takes his assessment of Franklin D. Roosevelt's words as fact when he said: "Franklin D. Roosevelt declared his dedication to the document, but as a statement of aspiration.... .. in the middle of the document.. ....I-caused-the-financial-crisis>.6. "Franklin D.
